Terms and Conditions
Please read these Terms and Conditions of Sale (‘terms’) and only proceed with your purchase if you wish to be bound by them. These Terms and conditions are between Trent Art of: 19 Brunswick Street, Newcastle under Lyme, Staffordshire, ST5 1HF and The Buyer.
1. Description of work / piece
1.1 All statements by us as to the authenticity, attribution, description, date, age, provenance, title or condition of the Work constitute our best judgment and opinion at the time of the sale. We do not accept any liability as a result of any changes in expert opinion that may take place subsequent to the sale.
1.2 All photographs, advertising and specifications provided by us are issued or published for the sole purpose of giving the very best representation of the Work but do not purport to be an exact or complete reproduction.
1.3 The copyright subsisting in all images and other materials produced for the sale of the Work is owned by us and such images and materials may only be used with our permission. We will have the right to use such images in our own discretion after the sale of the Work. For the avoidance of doubt, this sale does not transfer or assign or license any copyright or other intellectual property rights to you. During the period in which the Work is protected by copyright, the copyright remains with the artist (or any person to whom that right has been assigned). You are purchasing the Work, but not the right to produce copies of the Work (including photographs thereof) for publication or do any other act restricted by copyright. If such rights are sought, you should contact the copyright owner.
2. Price & Payment
2.1 The price listed or agreed as the result of an offer accepted in writing by us is the price you pay.
2.2 You must pay us the invoice Price for the Work, together with any agreed delivery costs, any VAT and any additional amounts payable to us in respect of export fees, taxes and duties for export sales.
3.1 We will deliver the Work to the address both parties have agreed in writing unless it is agreed in writing that you should collect it from us. UK deliveries will be dispatched within 48 hours and tracking numbers provided.
3.2 Any loss or damage prior to delivery shall be covered by the terms of our insurance. Upon receipt of delivery you will become responsible for the Work, for the risk of damage to it or loss of it.
4. Cancellations and returns
Your satisfaction with any purchase from Trent Art is 100% guaranteed. However, if for any reason you are not completely happy with your purchase, a full refund will be given.
4.1 In compliance of the Consumer Contract Regulations (June 2014) the Buyer has a legal right to cancel the Agreement. The Buyer’s right to cancel the Agreement starts from the date of the Order Confirmation, which is when the Agreement is formed. The Buyer may cancel the Agreement up to 14 working days from the day after Delivery. Your statutory rights as a consumer are not affected.
4.2 To cancel the Agreement, the Buyer should contact the Trent Art either by email or telephone. The Buyer’s cancellation is effective from the date the Buyer calls Trent Art or emails Trent Art to notify Trent Art of its desire to cancel the Agreement.
4.3 If the Buyer cancels the Agreement before dispatch of the work we will process a full refund of all monies paid. Trent Art will process the refund due to the Buyer as soon as possible and, in any case, within 30 calendar days of the day on which the Buyer gave Trent Art notice of cancellation. Trent Art will refund the Buyer on the credit card or debit card used by the Buyer to pay. If the Buyer has paid by bank transfer, the refund will be made to the bank account used to make the transfer.
4.4 If the Buyer wishes to return the Work to Trent Art because it is mis-described, Trent Art will refund the Price of such a Work in full, any applicable Delivery charges, and after cancellation any reasonable costs the Buyer incurs in returning the item to Trent Art.
4.5 If the Buyer wishes to return the Work to Trent Art for any other reason than described in 4.4 then the Buyer must return the Work to Trent Art as soon as reasonably practicable. If the Work requires collection, Trent Art may collect the Work from the address to which it was delivered. Trent Art will contact the Buyer to arrange a suitable time for collection. Under these circumstances the Buyer will be responsible for the cost of returning the Work to Trent Art.
4.6 The Buyer has a legal obligation to keep the Work in the Buyer’s possession and to take reasonable care of the Work while it is in the Buyer’s possession and ensure the Work is returned in the same condition as it was dispatched.
4.7 The Buyer is responsible for loss of and damage to any Work they return under clause 4.5
5.1 Trent Art is responsible for any website transaction and all credit card details are entered on a secure page and transferred using latest SSL technology.
Similar to other other commercial Web sites, our Web site utilizes a standard technology called “cookies” (see explanation below, “What Are Cookies?”) and Web server logs to collect information about how our Web site is used.
What Are Cookies?
A cookie is a very small text document, which often includes an anonymous unique identifier. IP addresses are used by your computer every time you are connected to the Internet. Your IP address is a number that is used by computers on the network to identify your computer. IP addresses are automatically collected by our web server as part of demographic and profile data known as “traffic data” so that data (such as the Web pages you request) can be sent to you. Like most websites we use Google Analytics to collect this data.
If you choose to correspond with us through email, we may retain the content of your email messages together with your email address and our responses. We provide the same protections for these electronic communications that we employ in the maintenance of information received online, mail and telephone.
How Do We Use the Information That You Provide to Us?
Broadly speaking, we use personal information for purposes of administering our business activities, providing customer service and making available other items and services to our customers and prospective customers.
We will not obtain personally-identifying information about you when you visit our site, unless you choose to provide such information to us, nor will such information be sold or otherwise transferred to unaffiliated third parties without the approval of the user at the time of collection.
We may disclose information when legally compelled to do so, in other words, when we, in good faith, believe that the law requires it or for the protection of our legal rights.

These terms and conditions and any non-contractual obligations arising from or in connection with them shall in all respects be construed and take effect in accordance with English law and both parties agree to submit to the exclusive jurisdiction of the English Courts.
